§ 9 Control

Pursuant to Section 9 (1) of the TNRSG, the Federal Minister of Health must monitor compliance with the provisions of the TNRSG and its ordinances. For this purpose, official inspection bodies are appointed by the Federal Ministry from among the AGES employees to carry out inspections.

The official inspection bodies are authorised to inspect all places where tobacco products and related products are placed on the market.
In the course of these controls, production and distribution records may be inspected and samples of tobacco and related products may be taken to the extent necessary for verification.
In addition, each distributor shall, upon request, send samples of each product once a year for the purpose of official control.
